Unfortunately, stream ripping of DI.fm is very much against the law.  DI.fm is a fully licensed radio station, therefore, once it's live it's done.

Oh, and I'm not so sure about it being completely "Illegal" to rip stations. I know its a licensed radio and all, but recorders are made for a purpose. I believe it becomes illegal to share such material, but the listening portion of it is completely fair.

The last paragraph specifically states:

"It has never been illegal to record a song off the radio in the context of fair use."

So it again depends on what happens to the music that is copied. If the copier up and sells the product, it infringes certain copy rights. However, Di.fm is a peculiar case, because for live shows such as that, there are no "royalties" as far as I know, being sent to Axiom or Leto as far as I know. So there may or may not be a line being stepped over.

However, i'm damn well sure it violates di.fm's code of conduct/terms of use. I wouldn't go as far as to say its punishable by law. I could only see that happening if a leaked "unreleased" version of a song got on the air that violated a contract with a label. But even then, I'm not completely sure that it wouldn't b di.fm taking the fall, as opposed to the user.

Couldnt Axiom and Leto just recorded it on their own. because its THEIR mix and THEIR session. so technically they wouldnt be "ripping" off of the station

You are all wrong wrong wrong.  No one listens.  DI.fm pays a certain copyright fee, and as a result, we are legally allowed to play whatever music we want without dishing out royalties to the artists we play.  Part of our contract stipulates that whatever is played on DI.fm is 100 percent exclusive to their station at the time it is played.  FURTHERMORE, NAHM is a program on DI.fm and we are merely taking part in that action.  I'm not saying that you will be arrested if you rip the stream, but you will, for example, be booted from the chat room if this happens. 

You guys do whatever the hell you want, but I don't want to lose my connection with DI.fm.

I'm not trying to garner a fight here Leto, don't get angry at me, I was just voicing an opinion. There are several more things that need to be said about this as well.

From vising di.fm's site, there is nothing actually available to us (unless it is hidden in the forums) about how one should go about listening to certain stations. What you are telling us, Leto, is what is specifically told to people who go to get their work put up on the radio. There is nothing that states to the common listener that these are exclusive mixes.

You are absolutely right though leto, as I said earlier. I'm sure it goes against di.fm's will for people to be ripping the stream. However if people aren't specifically announcing that they are ripping the stream, no one is going to go out of their way to try to find them. It's too much work for something that doesn't even have major repercussions.

It's also hard for a radio station to defend its stance on exclusive material when the radio station tends to play released CDs as well. It's one thing if it is a mix by say you are axiom because you guys control what happens to your material, but when labels sell their CDs and they fall into the hands of people who rip them and put them up onto the internet its an entirely different scenario.



Conclusion:
I myself don't condone what certain people do with certain streams/cds they own. However, I'll be damned if someone forbids me to record my best friends first mix on the air. If the situation was different, say a mother was listening to his son play on the air, and she recorded what he played on the air, no one would come after her. It is similar to this.

I have the last hour of the set. With Axiom's permission I'll do with it what he wants, because it is his set. However, I'm not going to go sell it to people. It's going to go on to my ipod so I can listen to it casually and so I can laugh at his terribly mature voice when it comes on. :p

^^Loyal2Death, I was not saying you were wrong, just Kaminari.  :)  And I wasn't mad, just being silly.

I am not going to stop you, and I think you are fine in ripping the stream for personal use.  HOWEVER, I personally don't want to get in trouble about it.  And I don't mean with the law, just with happyhardcore.com and DI.fm.  I am friends with Silver, and his input I value, just as you value Axiom's friendship enough to rip the stream.

No worries, and definitely no hard feelings.  It would be interesting to find out what the actual law is concerning that kind of infringement, just trust that it's probably a lot more stringent than is actually enforced.

You could probably ask the DI fm people to share the mix only on this forum for a day or so. or you could just share it with certain people. im sure they wouldnt punish you for sharing a mix if you had permission
